Ensuring You Get Your Fair Share in Property Division

Because Attorney Jim Zuba draws on his experience as a certified public accountant, our firm is in a great position when it comes to reaching a fair and equitable distribution of your marital assets in a divorce.

He can help determine the true value of a wide range of marital assets.
  • Professional practices, such as medical, dental, legal, and others
  • Manufacturing companies or other closely held businesses
  • Stocks and investments
  • Marital home and other real estate
  • Pensions, IRAs, 401(k)s, and other retirement funds
We're also prepared to bring in financial specialists when needed to help us arrive at the proper valuation of all assets.

Modify the Child Support You Pay or Receive

Although the terms of the property settlement in your divorce are final, modifications can be made to a number of other arrangements.
  • Financial support
  • Parental responsiblity & parenting time
For instance, you may be able to modify child support when your ex-spouse gets a promotion or you've become unemployed. Changes in your situation can lead to a variety of changes in court-ordered child support.

Whether you're seeking a modification or seek to prevent one, Zuba & Associates, P.C. is ready to represent you in Winnebago and Boone counties.

Modify Your Spousal Maintenance Agreement

If your ex-spouse has remarried or their income has risen substantially, you may qualify for a reduction or end spousal maintenance payments.

On the other hand, if your former spouse has been paying support and now earns more, you might be eligible for an increase in the payments you receive.

Modify Your Parenting Time

Generally speaking, in the first two years of a divorce decree, the courts will not modify parenting responsiblity or parenting time unless the child is in some kind of danger.

After two years, however, either you or your ex-spouse can request a modification based on changing circumstances - but only if it's in the child's best interests. Examples include a marked decline in your child's academics or if a new partner is abusive to the child.

Other modifications can be made as well:
  • Pickup and drop-off times
  • Overnight stays
  • Vacations
  • Visitation
Relocation rights are hard to obtain in Illinois since you will have to prove it is in the child's best interests. Talk to us, and we'll help you determine what modifications you can reasonably pursue.

Claim the Support Payments Your Child Needs

The Illinois law states the level of child support is determined by the income of both parents, but loopholes can sometimes benefit your ex-spouse and cost you.

Our attorneys can help you properly determine the level of support your child needs and whether you qualify for a deviation from the norm.

We also draw on our experience in accounting and use sophisticated software to uncover hidden income, such as under-reported earnings for the self-employed and undeclared income when a spouse is employed by a family member.

Think Ahead With a Proper Prenuptial Agreement

Looked at one way, a prenuptial agreement can help preserve the happiness of your new life together as a married couple.
  • Outline your expectations
  • Remove sources of potential conflict
  • Obtain peace of mind
  • Protect the personal property rights of each party
  • Communicate expectations for the marriage
We can help you avoid costly and destructive legal battles in the event of divorce by providing professional legal services.
  • Thoroughly reviewing proposed or existing agreements
  • Interpreting provisions of an agreement in accordance with relevant court decisions
  • Challenging the validity of an existing agreement
  • Enforcing the provisions of an agreement

Pursue Remarrying and Stepparent Adoption

Our office will assist you in pursuing a stepparent adoption, including preparing all the paperwork the court will need to establish whether the adoption is in the best interest of the child.

Since it may be necessary to terminate the rights of a biological parent, our attorneys will work with investigators, psychologists, health care professionals, and others to determine if that parent's rights should be ended.

Throughout the process, our experience will help you avoid delays and complications.

We also can help you deal with challenges to your adoption plan, as well as tax and health care issues, inheritance rights in estate planning, and Social Security issues.

Confirm or Deny Paternity in Parental & Support Cases

In order to provide for the well-being of a child, Zuba & Associates, P.C., will help you determine paternity and will support cooperative resolutions when there's an issue.

We represent men who seek to disprove paternity through court-ordered DNA tests or who want to establish their rights as fathers, and we represent women who want to determine paternity.

In either case, we can negotiate parenting time, child support, and parental responsibility.

Determine Parental Responsibility & Parenting Time

Don't let children get caught in the middle of a fight between you and an ex-spouse over parental rights and parenting time. Our firm promotes peaceful resolutions but when necessary, will represent your interests if it comes down to a trial.

Illinois law requires mediation in such disputes, so we can direct you to mediators with a proven record. At the same time, we will prepare you for the session.

If mediation is unsuccessful, the courts may appoint a guardian ad litem to look into your case. Once again, we can direct you to qualified professionals and advise you on how to handle the investigation that follows.

Take Your Parental Responsibility Case to Trial

We'll fiercely represent you in court if you believe that you should have sole parental responsibility or control over decision-making and primary parenting time.

A number of issues can work on your behalf.
  • The other parent mistreats the child
  • The other parent is unable to provide proper care
  • The other parent is unwilling to communicate regarding the best interests of the child
When necessary, we can help you identify and secure witnesses and gather evidence to show the other parent is unfit to share in parenting time.
