Holiday season gives way to spike in divorce filings in January

The end-of-year holiday season can bring families together or make some couples in Illinois resolve to end their marriages. People working in the legal field have long observed that filings for divorce jump in January. The month has earned the name Divorce Month although one study concluded that the most divorces actually happen in August and March.

One divorce attorney commented that the emotional stress of the holiday season could expose underlying problems between spouses. Alternatively, people striving to make merry during the holidays might experience a spike in dissatisfaction when the holidays are over and only daily reality remains.

A desire to preserve the family for the sake of the children through another holiday season typically causes couples to postpone divorce filings until January or later. The delay allows the parents to let their children enjoy the holidays without the stress and disruption or divorce proceedings.

Once a person makes the decision to pursue a divorce, legal advice could inform the person about what to do and what to expect. Someone confronted by the prospect of a high-asset divorce might want an attorney to manage negotiations about how to divide property or segregate nonmarital assets. Legal representation may help a person understand rights while making decisions about child support or spousal support. Those obligations could have lasting financial consequences, and an attorney may strive to broker an equitable divorce settlement. If disputes with the other partner prevent a person from coming to terms privately, then an attorney may prepare to litigate the issues in court. The advocacy of an attorney could allow someone to communicate needs effectively to a judge and challenge the demands of an ex-spouse.
