Illinois man facing drug and gun charges was recently paroled

Police in Illinois have reported that a 27-year-old man who was taken into custody on drug and weapons charges on Dec. 9 had been released from prison four months ago. Media accounts indicate that the man was apprehended after losing control of his vehicle while fleeing law enforcement. He faces a raft of charges, including the manufacture or delivery of a controlled substance, the possession of a firearm by a felon and aggravated fleeing and eluding.

According to a report from the Aurora Police Department, the sequence of events began when officers pulled over a Saturn sedan driven by the man at the intersection of West Indian Trail and North Elmwood Drive at approximately 5:45 p.m. Police say that the car was known to have been used to conduct drug sales in the vicinity of Wilder Street. The man is said to have attempted to flee the scene when one of the officers involved asked him to turn the vehicle off.

The ensuing pursuit ended a short time later on Upper Brandon Drive when the man lost control of his car and struck a tree. The vehicle came to a rest in a ditch according to reports. Police say that they discovered an undisclosed amount of crack cocaine along with items typically used to package and sell drugs in the car. Police also recovered a handgun on Durham Drive that they claim was tossed from the car by the man as he attempted to flee.

Experienced criminal defense attorneys would likely advise their clients not to flee law enforcement to avoid drug charges as doing so could make it far more difficult for them to negotiate favorable plea agreements. Attempting to flee the scene of a traffic stop also has very slim chances of success and gives police officers the probable cause they need to conduct warrantless vehicle searches.
