Man sentenced to 3 years in prison for DUI crash

On July 5, an Illinois man was sentenced to three years in prison for a drunk driving accident that occurred on Aug. 23, 2015. The 31-year-old man was handed several charges for his role in a two-car accident that seriously injured six people. After failing to stop at a stop sign, the man struck a car that was being driven by a 24-year-old woman with five passengers.

Three of the passengers that were injured in the drunk driving accident were minor females. The judge who sentenced the accused drunk driver ordered him to financially compensate the injured juveniles for their broken bones and disfigurements. The driver was ordered to pay more than $400,000 in restitution to the three injured passengers. After the man spends three years in prison, he will face three years of extended supervision followed by 11.5 years of probation.

Though the defendant claimed that he only drank one beer a couple of hours prior to the accident, a breath test showed that his BAC was more than three times the legal limit. He agreed to a plea deal and was convicted on two felony charges of first-degree recklessly endangering safety and three felony counts of injury by intoxicated use of a vehicle.

Breath tests are often used to test the blood alcohol content of suspected drunk drivers. However, they are not entirely reliable. A criminal defense attorney representing a client who is facing a DUI charge will sometimes choose to challenge the results on the basis that the machine was not properly calibrated. If successful, this could lead to a dismissal of the charge absent any other evidence.
