Kaley Cuoco, who is perhaps best known to people in Illinois for her role on the popular TV show “The Big Bang Theory,” filed for divorce from her husband earlier in 2015. Although initially not much was known about the filing, Cuoco now claims that her soon-to-be ex-husband’s addictions played an enormous role in her decision to divorce. Before saying “I do,” the couple signed a prenuptial agreement that addressed a variety of issues, including how to handle the division of property in the event of a divorce.

According to a source close to the couple, Ryan Sweeting — a professional tennis player — has had issues with both alcohol and drug addiction for years. At one point, he went to rehab for his problems with pain killers and alcohol but, upon his release, disappeared for several days. It is possible that this contributed to Cuoco’s decision, as she had reportedly already told him that she would leave if he did not get clean.

Since the filing, Sweeting filed a petition for spousal support. He also requested that the court terminate Cuoco’s ability to receive any type of support. In response, Cuoco pointed to the terms of their prenuptial agreement that already addressed how and when spousal support could be paid.

It is unclear if there has been any response from the court to any of Sweeting’s petitions, but it is unlikely that these requests will be granted unless all or part of the prenuptial agreement is first invalidated. Proving a prenup invalid can be an involved and lengthy process and is usually unnecessary for most couples in Illinois. Indeed, having an already established plan for the division of property as well as a myriad of other issues can help ensure that the process flows as smoothly as possible.
