Don't let your ex lie about income for a child support order

Although child custody laws in Illinois have only recently acknowledged that most children benefit from having both parents actively involved in their life, it has long been accepted that both parents should financially contribute to the basic needs of a child. Divorcing parents or those who were never married can both benefit from a child support order. However, if one parent is not being totally honest about what he or she makes, determining an accurate amount for child support can be difficult.

One of the first things that must be established is who -- if anyone -- will receive child support. In general, the noncustodial parent pays the custodial parent, although this issue may be more complex for those who share joint custody. If time is split equally between parents or if one earns a significant higher income, he or she may be required to pay child support.

Unfortunately, it is not unheard of for some parents to attempt to wrongly reduce the amount of child support that they owe. Parents who are self-employed may have the opportunity to underreport his or her earnings, while those who work for a relative could possibly have income that is undeclared. Ultimately, it's the child who is most harmed by this type of deceit and not the other parent.

Most parents may hope that his or her child's other parent would want to be honest with income in order to provide for the child as needed.
